Well, intention, choice, might be hard for an observer to discern, given a human being and a well-programmed robot.  But are you writing about discerning from 3rd position, as oneself, to discover one's own consciousness?

Some epistemological arguments for the existence of the external world rely on a personal 1st, 2nd, or 3rd position investigation of one's own consciousness.

Also, Searle's idea of nonconsciousness, versus unconsciousness, might be important to appreciating the existence of an unconscious array of actions when making a choice, versus a nonconscious array.
